ORDINANCE NO. 3161

AN ORDINANCE TO FURTHER AMEND ORDINANCE NO. 1883 OF THE CITY OF AUBURN, DATED DECEMBER 21, 1999, AS AMENDED, TO REZONE:

1. THE PROPERTIES SHOWN IN EXHIBIT “A” FROM COMPREHENSIVE DEVELOPMENT DISTRICT (CDD) AND DEVELOPMENT DISTRICT HOUSING (DDH) TO MEDIUM DENSITY

RESIDENTIAL DISTRICT (MDRD).

2. THE PROPERTIES SHOWN IN EXHIBIT “A” FROM REDEVELOPMENT DISTRICT (RDD) TO DEVELOPMENT DISTRICT HOUSING (DDH).

3. THE PROPERTIES SHOWN IN EXHIBIT “A” FROM NEIGHBORHOOD CONSERVATION (NC-12) TO CORRIDOR REDEVELOPMENT DISTRICT - EAST (CRD-E).

4. THE PROPERTIES SHOWN IN EXHIBIT “A” FROM CORRIDOR REDEVELOPMENT DISTRICT - URBAN (CRD-U) TO CORRIDOR REDEVELOPMENT DISTRICT - EAST (CRD-E).

5. THE PROPERTIES SHOWN IN EXHIBIT “A” FROM COMPREHENSIVE DEVELOPMENT DISTRICT (CDD) TO CORRIDOR REDEVELOPMENT DISTRICT - SUBURBAN (CRD-S).

6. THE PROPERTIES SHOWN IN EXHIBIT “A” FROM COMPREHENSIVE DEVELOPMENT DISTRICT (CDD) AND DEVELOPMENT DISTRICT HOUSING (DDH) TO CORRIDOR

REDEVELOPMENT DISTRICT - SUBURBAN (CRD-S).

7. THE PROPERTIES SHOWN IN EXHIBIT “A” FROM NEIGHBORHOOD CONSERVATION (NC-12), NEIGHBORHOOD CONSERVATION (NC-11) AND NEIGHBORHOOD

CONSERVATION (NC-15) TO DEVELOPMENT DISTRICT HOUSING (DDH).

8. THE PROPERTIES SHOWN IN EXHIBIT “A” FROM REDEVELOPMENT DISTRICT (RDD) TO LIMITED DEVELOPMENT DISTRICT (LDD).

9. THE PROPERTIES SHOWN IN EXHIBIT “A” FROM NEIGHBORHOOD CONSERVATION (NC-5), DEVELOPMENT DISTRICT HOUSING (DDH), CORRIDOR REDEVELOPMENT

DISTRICT – URBAN (CRD-U) AND REDEVELOPMENT DISTRICT (RDD) TO CORRIDOR REDEVELOPMENT DISTRICT – EAST (CRD-E).

10. THE PROPERTIES SHOWN IN EXHIBIT “A” FROM NEIGHBORHOOD CONSERVATION (NC-5) TO DEVELOPMENT DISTRICT HOUSING (DDH).

BE IT ORDAINED by the City Council of the City of Auburn, Alabama, as follows:

Section 1. That Ordinance No. 1883 of the City of Auburn, Alabama dated December 21, 1999, as amended by subsequent amendments is further amended in the following respect:

The zoning map of the City of Auburn, Alabama, which is made an exhibit to and is a part of said Ordinance No. 1883, is amended to rezone properties shown in Exhibit “A” from:

1. FROM COMPREHENSIVE DEVELOPMENT DISTRICT (CDD) AND DEVELOPMENT DISTRICT HOUSING (DDH) TO MEDIUM DENSITY RESIDENTIAL DISTRICT (MDRD). THE

PROPERTIES ARE LCOATED AT THE NORTHWEST CORNER OF THE INTERSECTION OF NORTH DEAN ROAD AND ANNALUE DRIVE, MORE SPECIFIC 420 NORTH DEAN ROAD

AND 919 ANNALUE DRIVE.

2. FROM REDEVELOPMENT DISTRICT (RDD) TO DEVELOPMENT DISTRICT HOUSING (DDH). THE PROPERTY IS LOCATED AT 923 EAST GLENN AVENUE.

3. FROM NEIGHBORHOOD CONSERVATION (NC-12) TO CORRIDOR REDEVELOPMENT DISTRICT - EAST (CRD-E). THE PROPERTIES ARE LOCATED ON THE WEST SIDE OF

NORTH DEAN ROAD (EXCLUDING 435 NORTH DEAN ROAD) BETWEEN HARPER AVENUE AND OLD STAGE ROAD, WHICH INCLUDE LOTS 1 THROUGH 10 OF THE KIDD

SUBDIVISION RECORDED FEBRUARY 15, 1958 AND LOTS 1-14 OF THE WITTLE SUBDIVISION NO. TWO RECORDED FEBRUARY 2, 1956.

4. FROM CORRIDOR REDEVELOPMENT DISTRICT - URBAN (CRD-U) TO CORRIDOR REDEVELOPMENT DISTRICT - EAST (CRD-E). THE PROPERTIES ARE LOCATED FRONTING

THE NORTH SIDE OF EAST GLENN AVENUE BEGINNING AT THE INTERSECTION OF CHARLESTON PLACE (MORE SPECIFICALLY, LOT 16 THROUGH 25 OF THE REVISION OF

THE WOODWYN SUBDIVISION RECORDED AUGUST 8, 1955).

5. FROM COMPREHENSIVE DEVELOPMENT DISTRICT (CDD) TO CORRIDOR REDEVELOPMENT DISTRICT - SUBURBAN (CRD-S). THE PROPERTY CONSISTS OF THE PORTION

OF LOT 1-B THE REDIVISION OF LOT 1, GLENDEAN SUBDIVISION RECORDED JANUARY 17, 2001 ON THE EAST SIDE OF CHARLESTON PLACE.

6. FROM COMPREHENSIVE DEVELOPMENT DISTRICT (CDD) AND DEVELOPMENT DISTRICT HOUSING (DDH) TO CORRIDOR REDEVELOPMENT DISTRICT - SUBURBAN (CRDS).

THE PROPERTY CONSISTS OF THE SOUTH PORTION OF LOT 1-B THE REDIVISION OF LOT 1, GLENDEAN SUBDIVISION RECORDED JANUARY 17, 2001 ON AND LOT 2 OF THE

GLENDEAN SUBDIVISION FIRST ADDITION.

9. FROM NEIGHBORHOOD CONSERVATION (NC-5), DEVELOPMENT DISTRICT HOUSING (DDH), CORRIDOR REDEVELOPMENT DISTRICT – URBAN (CRD-U) AND

REDEVELOPMENT DISTRICT (RDD) TO CORRIDOR REDEVELOPMENT DISTRICT – EAST (CRD-E). THE PROPERTIES ARE LOCATED FRONTING THE EAST SIDE OF DEAN

ROAD BEGINNING AT EAST GLENN AVENUE SOUTH TO MCKINLEY AVENUE AND FROM DEAN ROAD EAST TO SHORT STREET, MORE SPECIFIC: THE PROPERTIES

ADDRESSED AS 818, 824, 830, AND 838 EAST GLENN AVENUE; 149, 155, AND 161 SHORT STREET; 802, 810, 813, 816, 819, 824, AND 827 LAKEVIEW DRIVE, 108, 124, AND 140 NORTH

DEAN ROAD, 802 A-D AND 803 A-E EAST MAGNOLIA AVENUE, AND 107-109 AND 111-113 SOUTH DEAN ROAD.

10. FROM NEIGHBORHOOD CONSERVATION (NC-5) TO DEVELOPMENT DISTRICT HOUSING (DDH). THE PROPERTIES INCLUDE 813, 817, 825, AND 829 COTTAGE LANE, 805-807,

809-811, 815-817, 821, 861, 901 EAST MAGNOLIA AVENUE, THE PROPERTY LOCATED AT THE NORTHWEST CORNER OF EAST MAGNOLIA AVENUE AND MAPLE STREET, 807-809,

815-817, AND 821-823 MCKINLEY AVENUE AND THE PROPERTUES BETWEEN SOUTH DEAN ROAD AND MAPLE STREET AND PARK AVENUE AND MCKINLEY AND PARK

AVENUE (EXCULDING BAPTIST HILL CEMETERY).

Section 2. If any section or provision of this ordinance be declared invalid or unconstitutional by judgment or decree of a court of competent jurisdiction, such judgment or decree shall

not affect any other section or provision of this ordinance.

Section 3. If any section or provision of the City of Auburn Zoning Ordinance be declared invalid or unconstitutional by judgment or decree of a court of competent jurisdiction, such

judgment or decree shall not affect the provision of this ordinance.

Section 4. This ordinance shall take effect upon its approval by the City Council or upon its otherwise becoming law, but shall be published as required by law and codified as part of the

Code of Auburn, Alabama.
