ORDINANCE NO. 3200

AN ORDINANCE TO FURTHER AMEND ORDINANCE NO. 1883 OF THE CITY OF AUBURN, DATED DECEMBER 21, 1999, AS AMENDED, TO AMEND ORDINANCE 2463 THAT APPROVED THE PLANNED DEVELOPMENT DISTRICT (PDD) DESIGNATION WITH AN UNDERLYING ZONING OF COMPREHENSIVE DEVELOPMENT DISTRICT (CDD) ON APPROXIMATELY 253 ACRES OF PROPERTY, KNOWN AS THE GREENS AT AUBURN, LOCATED AT THE SOUTHEAST CORNER OF SOUTH COLLEGE STREET AND SANDHILL ROAD. THE APPLICANT IS PROPOSING TO MODIFY A PORTION OF THE COMMERCIAL AREA BY CHANGING APPROXIMATELY 15.67 ACRES TO A RESIDENTIAL USE (MULTIPLE UNIT DEVELOPMENT).

BE IT ORDAINED by the City Council of the City of Auburn, Alabama, as follows:
Section 1. That Ordinance No. 1883 of the City of Auburn, Alabama dated December 21, 1999, as amended by subsequent amendments is further amended in the following respect:

The zoning map of the City of Auburn, Alabama, which is made an exhibit to and is a part of said Ordinance No. 1883 to amend the Planned Development District (PDD) Designation on approximately 253 acres. The following describes the real property:

Section 2. If any section or provision of this ordinance be declared invalid or unconstitutional by judgment or decree of a court of competent jurisdiction, such judgment or decree shall not affect any other section or provision of this ordinance.

Section 3. This ordinance shall take effect upon its approval by the City Council or upon its otherwise becoming law, but shall be published as required by law and codified as part of the Code of Auburn, Alabama.
