In accordance with the provisions of Section 11-45-8 of the Code of Alabama, the following ordinance is published in synopsis form in The Auburn Villager as follows:
ORDINANCE NO. 3182
AN ORDINANCE GRANTING AN EIGHT YEAR, NON-EXCLUSIVE FRANCHISE TO POINT BROADBAND OF OPELIKA, LLC TO CONSTRUCT, OPERATE, MAINTAIN AND
UPGRADE A CABLE SYSTEM IN THE CITY OF AUBURN, ALABAMA SETTING FORTH CONDITIONS ACCOMPANYING THE GRANT OF THE FRANCHISE; PROVIDING
FOR REGULATION AND USE OF THE SYSTEM AND THE PUBLIC RIGHTS-OF-WAY AND PRESCRIBING PENALTIES FOR THE VIOLATION OF THE PROVISIONS
This ordinance grants an eight year, non-exclusive franchise to a cable company for the construction and operation of a cable system within the corporate boundaries of the City, as they
exist from time to time. The Franchisee shall pay to the City a quarterly Franchise Fee equal to five percent (5%) of Franchisee’s quarterly Gross Revenues derived by Franchisee from the
operation of its cable system within the City. The ordinance imposes certain requirements on the Franchisee relating to the construction and operation of the cable system and the
provision of services within the City limits.…………….
