ORDINANCE NO. 3186
AN ORDINANCE TO FURTHER AMEND ORDINANCE NO. 1883 OF THE CITY OF AUBURN, DATED DECEMBER 21, 1999, AS AMENDED, TO REZONE PROPERTY LOCATED AT 2826
COX ROAD. THIS IS A REQUEST TO REZONE APPROXIMATELY 3.18 ACRES FROM RURL (R) TO COMPREHENSIVE DEVELOPMENT DISTRICT (CDD).
BE IT ORDAINED by the City Council of the City of Auburn, Alabama, as follows:
Section 1. That Ordinance No. 1883 of the City of Auburn, Alabama dated December 21, 1999, as amended by subsequent amendments is further amended in the following respect:
The zoning map of the City of Auburn, Alabama, which is made an exhibit to and is a part of said Ordinance No. 1883, is amended to rezone approximately 3.18 acres from Rural (R) to
Comprehensive Development District (CDD). The following describes the real property:
Begin at the Southeast corner of Section 10, Township 18 North, Range 25 East, Auburn, Lee County, Alabama, thence due West 1347.0 feet to an iron pin located on the West margin of Cox
Road for a corner and starting point of the parcel herein to be described: From this starting point, thence South 89 degrees 59’ 52” West, 400.10 feet to an iron pin for a corner; thence North
11 degrees 07’ 00” East, 461.28 feet to an iron pin for a corner; thence South 89 degrees 57’ 18” East, 388.05 feet to an iron pin located on the West margin of Cox Road for a corner; thence
South 10 degrees 51’ 50” West margin of Cox Road for a distance of 178.08 feet to a concrete right-of-way monument (PT 200+40.8); thence in a southwesterly direction along a curve to the
left of the West right of way of Cox Road for a distance of 280.84 feet on a radius of 3859.40 feet, said curve having a chord bearing of South 08 degrees 52’ 37” West and a chord distance of
280.77 feet to the starting point.
Less and Except A Parcel of Land situated in the S . of the SE . of Section 10, Township 18 North, Range 25 East, identified as Tract No. 3 on Project IM-I085 (311) in Lee County, Alabama
and being more particularly described as follows: Commence at the Northeast corner of section 15. Thence westerly along the north section line of said section a distance of 1314.74 feet to
station 182+73.62 on the centerline of said project. Thence continue along said section line a distance of 30 feet, more or less to a point. This point being the accepted southeast corner of the
property described in deed book 2033 page 148 of Lee County, Alabama and the point of beginning for the parcel described herein. Thence westerly along said property line a distance of 82
feet, more or less, to a point 110.00 feet perpendicularly west of the centerline of said project. Thence northerly along a line 110.00 feet west of said centerline, a distance of 460 feet, more or
less, to a point on the north property line of said property. Thence easterly along said property line a distance of 72 feet, more or less, to a point on the west right-of-way line of Cox Road.
Thence southerly along said right right-of-way line, a distance of 188 feet, more or less, to a point. Thence continue along said right-of-way an arc distance of 271 feet, more or less, to the
point of beginning containing 0.77 acres, more or less.
Section 2. If any section or provision of this ordinance be declared invalid or unconstitutional by judgment or decree of a court of competent jurisdiction, such judgment or decree shall
not affect any other section or provision of this ordinance.
Section 3. This ordinance shall take effect upon its approval by the City Council or upon its otherwise becoming law, but shall be published as required by law and codified as part of the
Code of Auburn, Alabama.
