ORDINANCE NO. 3344

AN ORDINANCE TO FURTHER AMEND ORDINANCE NO. 1883 OF THE CITY OF AUBURN, DATED DECEMBER 21, 1999, AS AMENDED, TO REZONE APPROXIMATELY 44.8 ACRES,

MORE OR LESS, LOCATED NEAR THE SOUTHWEST CORNER OF THE INTERSECTION OF U.S. HIGHWAY 280 AND NORTH COLLEGE STREET. THIS IS A REQUEST TO REZONE

THE SUBJECT PROPERTY FROM RURAL (R) TO COMPREHENSIVE DEVELOPMENT DISTRICT (CDD)

BE IT ORDAINED by the City Council of the City of Auburn, Alabama, as follows:

Section 1. That Ordinance No. 1883 of the City of Auburn, Alabama dated December 21, 1999, as amended by subsequent amendments is further amended in the following respect:

The zoning map of the City of Auburn, Alabama, which is made an exhibit to and is a part of said Ordinance No. 1883, is amended to rezone approximately 44.8 acres, more or less, located

near the southwest corner of the intersection of U.S. Highway 280 and North College Street. This is a request to rezone the subject property from Rural (R) to Comprehensive Development

District (CDD).

The property in question is more specifically described as follows:

Commencing at a .” Crimp top iron pipe at the Northwest Corner of Section 6, Township 19 North, Range 26 East, Auburn, Lee County, Alabama, said point being the Point of Beginning

of the Earnest Property described herein: from this POINT OF BEGINNING, thence along the East line of the Auburn University property North 00°32'05" West, a distance of 1861.18 feet to

a found open top pipe; thence along the South line of the Farmville Community Club Property South 87°39'59" East, a distance of 301.97 feet to set .” rebar by Barrett Simpson Inc (BSI);

thence South 87°39’59” East, 496.23 feet to a calculated point on the Southwest right of way for US Highway 280; thence along said Highway on a curve to the right with a radius of 3869.66

feet, an arc length of 36.70 and a chord of South 48°06’33” East, 36.70 feet to a calculated point; thence continue along said Highway South 48°06’33” East, 217.10 feet to a found .” rebar;

thence along the Northwest line of Lot B1 of The Bottle Subdivision South 42°07’40” West, 318.57 feet to a found .” open top pin; thence along the Southwest line of Lots B1 and B2, The

Bottle Subdivision South 47°52'46" East, a distance of 339.79 feet to a found .” rebar; thence along the west line of Parcel C of the Joe Earnest Survey South 06°54'34" West, a distance of

170.20 feet to a found pin by Zack D Sprayberry (ZDS); thence North 87°29'33" East, a distance of 318.92 feet to a found pin (ZDS) in the West right of way of Alabama 147; thence along said

right of way for Alabama 147 South 15°19'01" West, a distance of 555.17 feet to a found pin (ZDS); thence along the limits of Parcel D-1 of the Proposed Earnest Survey North 60°52'32" West, a

distance of 391.68 feet to a found pin (ZDS); thence continue along D-2 South 15°09'46" West, a distance of 617.28 feet to a found pin (ZDS); thence along an extension for Parcel D-2 South

15°09'46" West, a distance of 15.05 feet to a set .” rebar (BSI); thence along Parcel D-2 South 79°33'08" East, a distance of 380.10 feet to a set .” rebar (BSI) in the West right of way of

Alabama 147; thence along said right of way South 15°18'50" West, a distance of 385.47 feet; thence leaving said right of way and follow a zoning line North 75°04'56" West, a distance of 506.77

feet to a calculated point; thence North 75°04'56" West, a distance of 50.09 feet to a calculated point; thence North 11°34'03" East, a distance of 40.00 feet to a calculated point; thence North

78°25'57" West, a distance of 125.00 feet to a calculated point; thence North 81°59'49" West, a distance of 171.05 feet to a calculated point; thence South 88°46'40" West, a distance of 101.21 feet to

a calculated point in the East line of the Auburn University Property; thence along said property line North 00°07’32” West, 126.63 feet to the Point of Beginning.

Said Parcel lies in Section 6, Township 19 North, Range 26 East and Section 31, Township 20 North, Range 26 East containing 44.8 Acres, more or less.

Section 2. If any section or provision of this ordinance be declared invalid or unconstitutional by judgment or decree of a court of competent jurisdiction, such judgment or decree shall

not affect any other section or provision of this ordinance.

Section 3. This ordinance shall take effect upon its approval by the City Council or upon its otherwise becoming law, but shall be published as required by law and codified as part of the

Code of Auburn, Alabama.
