ORDINANCE NO. 3343

AN ORDINANCE TO FURTHER AMEND ORDINANCE NO. 1883 OF THE CITY OF AUBURN, DATED DECEMBER 21, 1999, AS AMENDED, TO REZONE APPROXIMATELY 19.4 ACRES,

MORE OR LESS, LOCATED NEAR THE SOUTHWEST CORNER OF THE INTERSECTION OF U.S. HIGHWAY 280 AND NORTH COLLEGE STREET. THIS IS A REQUEST TO REZONE

THE SUBJECT PROPERTY FROM RURAL (R) TO DEVELOPMENT DISTRICT HOUSING (DDH)

BE IT ORDAINED by the City Council of the City of Auburn, Alabama, as follows:

Section 1. That Ordinance No. 1883 of the City of Auburn, Alabama dated December 21, 1999, as amended by subsequent amendments is further amended in the following respect:

The zoning map of the City of Auburn, Alabama, which is made an exhibit to and is a part of said Ordinance No. 1883, is amended to rezone approximately 19.4 acres, more or less, located

near the southwest corner of the intersection of U.S. Highway 280 and North College Street. This is a request to rezone the subject property from Rural (R) to Development District Housing

(DDH).

Commencing at a .” Crimp top iron pipe at the Northwest Corner of Section 6, Township 19 North, Range 26 East, Auburn, Lee County, Alabama, thence South 00°07'32" East, a distance of

126.63 feet to a calculated point in the East line of the Auburn University Property and the intersection of said line with a zoning line, said point begin the point of beginning of a zoning

parcel described herein: from this POINT OF BEGINNING, thence along said zoning line North 88°46'40" East, a distance of 101.21 feet to a calculated point; thence South 81°59'49" East, a

distance of 171.05 feet to a calculated point; thence South 78°25'57" East, a distance of 125.00 feet to a calculated point; thence South 11°34'03" West, a distance of 40.00 feet to a calculated

point; thence South 75°04'56" East, a distance of 50.09 feet to a calculated point; thence South 75°04'56" East, a distance of 506.77 feet to a calculated point in the West right of way of Alabama

Highway 147; South 15°18'50" West, a distance of 889.00 feet to a set .” rebar (BSI); thence North 73°53'21" West, a distance of 32.27 feet to a found .” rebar by Precision Surveying (CA788);

thence along the North line of Lot 3 of Lily Lovey Bradley Subdivision South 79°44'21" West, a distance of 654.26 feet to a found .” rebar (CA788) at a fence line for Auburn University;

thence crossing Auburn University fence line South 02°41’54” West, a distance 221.04 feet to a set .” rebar (BSI) 3.3 West of the Auburn university fence line; thence along a line North

00°07'32" West, a distance of 1541.71 feet to the Point of Beginning. Said Parcel lies in Section 6, Township 19 North, Range 26 East containing 19.4 Acres, more or less.

Section 2. If any section or provision of this ordinance be declared invalid or unconstitutional by judgment or decree of a court of competent jurisdiction, such judgment or decree shall

not affect any other section or provision of this ordinance.

Section 3. This ordinance shall take effect upon its approval by the City Council or upon its otherwise becoming law, but shall be published as required by law and codified as part of the

Code of Auburn, Alabama.

ADOPTED AND APPROVED by the City Council of the City of Auburn, Alabama, this the 16th day of November, 2021.
