ORDINANCE NO. 3332

AN ORDINANCE TO FURTHER AMEND ORDINANCE NO. 1883 OF THE CITY OF AUBURN, DATED DECEMBER 21, 1999, AS AMENDED, TO REZONE APPROXIMATELY 20.78 ACRES,

MORE OR LESS, LOCATED AT THE TERMINUS OF SOUTHVIEW DRIVE FROM RURAL (R) TO DEVELOPMENT DISTRICT HOUSING (DDH).

BE IT ORDAINED by the City Council of the City of Auburn, Alabama, as follows:

Section 1. That Ordinance No. 1883 of the City of Auburn, Alabama dated December 21, 1999, as amended by subsequent amendments is further amended in the following respect:

The zoning map of the City of Auburn, Alabama, which is made an exhibit to and is a part of said Ordinance No. 1883, is amended to rezone approximately 20.78 acres, more or less, located

at the terminus of Southview Drive from Rural (R) to Development District Housing (DDH). The following describes the real property:

Lee County Tax Parcel 1803060000099000, more specifically described as follows: COMMENCE AT A FOUND 1/2" REBAR (CAPPED "CA 2321 AL 11282") AT THE SOUTHWEST CORNER

OF SECTION6, TOWNSHIP 18 NORTH, RANGE 25 EAST, LEE COUNTY, ALABAMA (PER DEED BOOK 1243, PAGE 11); THENCERUN N01°10'07"E, A DISTANCE OF 121.23 FEET TO A

FOUND 2" OPEN TOP PIPE LOCALLY ACCEPTED AS BEINGTHE SOUTHWEST CORNER OF SECTION 6, TOWNSHIP 18 NORTH, RANGE 25 EAST, LEE COUNTY, ALABAMA

(PERPLAT BOOK 14, PAGE 125), SAID PIPE BEING THE POINT OF BEGINNING.

THENCE RUN N 43°09'23” E A DISTANCE OF 1129.15 FEET TO A FOUND 3/8” OPEN TOP PIPE; THENCE RUN N39°25'23” E, A DISTANCE OF 364.45 FEET TO A FOUND 2” OPEN TOP

PIPE FOUND; THENCE RUN N 89°24'28” EA DISTANCE OF 1099.22 FEET TO A SET 1/2” REBAR (CAPPED “ALS-0173”) ON THE WEST RIGHT-OF-WAY OF USINTERSTATE HIGHWAY

85 (300' ROW); THENCE RUN ALONG SAID RIGHT-OF-WAY S 53°57'59” W A DISTANCEOF 1966.14 FEET TO A SET 1/2” REBAR (CAPPED “ALS-0173”); THENCE LEAVING SAID

RIGHT-OF-WAY RUN N85°32'25” W A DISTANCE OF 514.53 FEET TO THE POINT OF BEGINNING.

BEING SITUATED IN THE SOUTHWEST 1/4 OF THE SOUTHWEST 1/4 OF SECTION 6, TOWNSHIP 18 NORTH, RANGE 25 EAST, LEE COUNTY, ALABAMA AND CONTAINING 20.78

ACRES, MORE OR LESS.

Section 2. If any section or provision of this ordinance be declared invalid or unconstitutional by judgment or decree of a court of competent jurisdiction, such judgment or decree shall

not affect any other section or provision of this ordinance.

Section 3. This ordinance shall take effect upon its approval by the City Council or upon its otherwise becoming law, but shall be published as required by law and codified as part of the

Code of Auburn, Alabama.

ADOPTED and approved by the City Council of the City of Auburn, Alabama, this the 5th day of October, 2021.
