ORDINANCE NO. 3266
AN ORDINANCE TO FURTHER AMEND ORDINANCE NO. 1883 OF THE CITY OF AUBURN, DATED DECEMBER 21, 1999, AS AMENDED, TO REZONE APPROXIMATELY 1.9 ACRES, MORE OR LESS, FROM RURAL (R) TO DEVELOPMENT DISTRICT – HOUSING (DDH) LOCATED AT THE TERMINUS OF SUTHERLAND LANE.
BE IT ORDAINED by the City Council of the City of Auburn, Alabama, as follows:
Section 1. That Ordinance No. 1883 of the City of Auburn, Alabama dated December 21, 1999, as amended by subsequent amendments is further amended in the following respect:
The zoning map of the City of Auburn, Alabama, which is made an exhibit to and is a part of said Ordinance No. 1883, is amended to rezone approximately 1.9 acres, more or less, from Rural (R) to Development District - Housing (DDH) located at the terminus of Sutherland Lane.
Commencing at a found 3⁄4” T Richard Fuller Land Surveying (TRF) iron pin at the East end of Sutherland Lane and the Northeast corner of Lot 623, Camden Ridge, 11th Addition, Phase One as recorded in plat book 29, page 164, said point also being the Point of Beginning of a portion of Donahue Lands LLC property to be annexed into the City of Auburn, said parcel described herein: from this POINT OF BEGINNING; thence North 00°41'07" East, a distance of 50.27 feet to a found 3⁄4” TRF iron pin at the Southeast corner of Lot 622, Camden Ridge, 11th Addition, Phase One as recorded in plat book 29, page 164; thence along the South line of Lot 53 Northwoods, South Section, Redivision Of Lot 1, as recorded in Plat book 42 at page 114 North 88°16'28" East, a distance of 180.37 feet to the Southeast corner of said Lot 53; thence along the East line of said lot North 09°26'13" West, a distance of 68.20 feet to the beginning of a curve tangent to said line; thence along a curve of said lot for an arc distance of 66.85 feet along the curve concave to the east, having a radius of 325.01 feet and a chord of North 03°32’38” West, 66.74; thence leaving lot 53 North 82°39'52" East, a distance of 130.64 feet; thence South 33°58'36" East, a distance of 135.05 feet; thence South 29°50'22" East, a distance of 50.00 feet; thence along a curve concave to the northwest having a radius of 325.12 feet, an arc length of 51.54 and a chord which bears South 64°49'53" West 51.49 feet; thence South 07°31'40" East, a distance of 147.92 feet; thence South 88°04'28" West, a distance of 313.35 feet; thence North 01°56'56" West, a distance of 129.98 feet; thence South 88°03'04" West, a distance of 50.73 feet to the Point of Beginning. Containing 1.90 ACRES, more or less.
Section 2. If any section or provision of this ordinance be declared invalid or unconstitutional by judgment or decree of a court of competent jurisdiction, such judgment or decree shall not affect any other section or provision of this ordinance.
Section 3. This ordinance shall take effect upon its approval by the City Council or upon its otherwise becoming law, but shall be published as required by law and codified as part of the Code of Auburn, Alabama.
