ORDINANCE NO. 3232

AN ORDINANCE OF THE CITY OF AUBURN, ALABAMA, TO EXTEND ORDINANCE NUMBER 3204 DECLARING A MORATORIUM ON THE CONSTRUCTION OF PRIVATE DORMITORY AND ACADEMIC DETACHED DWELLING UNIT DEVELOPMENTS WITHIN THE CITY.

WHEREAS, on February 18, 2020 the City of Auburn, Alabama, enacted Ordinance Number 3204 which provided for a moratorium on the construction of Private Dormitory and Academic Detached Dwelling Unit developments within the City; and

WHEREAS, said Ordinance was to continue through May 27, 2020 unless terminated or extended by action of the City Council; and
WHEREAS, said Ordinance was put into place to allow City staff to formulate recommendations to the Planning Commission and City Council to manage the proliferation of Private

Dormitory and Academic Detached Dwelling Unit developments; and

WHEREAS, in order for City staff to complete their recommendations and present such for adoption, it is necessary that the recommendations be thoroughly vetted and commented on by the public; and

WHEREAS, due to the COVID-19 pandemic and related orders from the Governor and the Alabama Department of Public Health there has not been an opportunity for the staff to present the draft recommendations for public review and comment; and

WHEREAS, in order to provide time for adequate public comment and input prior to presentation and adoption of the recommendations, a 90-day extension of the moratorium beyond May 27, 2020 is warranted.

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Auburn, Alabama, on May 19, 2020 as follows:
Section 1. That Ordinance Number 3204 adopted by the City Council on February 18, 2020 is hereby extended an additional 90-days from its original date of expiration, until August 25,

2020, unless terminated or further extended by action of the City Council.
