IN THE CIRCUIT COURT, THIRTY SEVENTH JUDICIAL CIRCUIT IN AND FOR LEE COUNTY, ALABAMA

THE ESTATE OF JAMES EDWARD HERZING, by and through its Executor, JOSEPH HERZING, Plaintiff,

vs.

ONE (1) ACRE OF REAL PROPERTY, BROOKE HERZING, VALERIE HERZING, ROSS W. BRACEY, III AND JENNIFER JUANISE BRACEY, Defendants(s)

BROOKE HERZING, and any other persons who may claim an interest in the real property more particularly described herein ("Defendants"), must answer the Complain to Quiet Title, filed by THE ESTATE OF JAMES EDWARD HERZING, by and through its Executor JOSEPH HERZING ("Plantiff"), on or before January 29, 2021, or a Judgment by Default may be rendered against them in Lee County Case No. CV-2020-900437.00. The real property situated in Lee County, Alabama is more particularly described as:

Commence at Northeast corner of Section 19, Township 19 North, Range 27 East, in Lee County, Alabama, thence run South 89 degrees 41 minutes West for 84.4 feet; thence run South 00 degrees 19 minutes East for 3666.5 feet to the point of beginning of the lot or parcel of land herein to be described and conveyed (said point of beginning being on the Westerly margin of Alabama State Highway No. 37); from said point of beginning thence run South 00 degrees 19 minutes East, along the Westerly margin of Alabama State Highly No. 37, for 100.0 feet; thence run South 87 degrees 53 minutes West for 200.0 feet; thence run North 00 degrees 19 minutes West for 100.0 feet; thence run North 87 degrees 53 minutes East for 200.0 feet to the said point of beginning together with all appurtenances thereunto appertaining.

The above described property is further described as being a portion of the tract of land conveyed by Hattie T. Hall, as Executrix to Erie M. Hall by corrective Deed dated July 2, 1958, of record in Deed Record Book 495 at Page 85 in the office of the Judge of Probate of Lee County, Alabama; and is further described as being bounded on the North side by the lot conveyed by J. Frank Reed and wife to J.M. Beck, Sr., by Deed dated July 31, 1958, recorded in Deed Book 495 at page 450 in the Office of the Judge of Probate of Lee County, Alabama, and being bounded on the East side by Alabama State Highway No. 37.

Commence at Northeast corner of Section 19, Township 19 North, Range 27 East, in Lee County, Alabama; thence run South 89 degrees 41 minutes West for 84.4 feet; thence run South 00 degrees 19 minutes East for 3566.5 feet to the point of beginning of the lot or parcel of land herein to be described and conveyed (said point of beginning being on the Westerly margin of Alabama State Highway No. 37); from said point of beginning thence run South 00 degrees 19 minutes East, along the Westerly margin of Alabama State Highway No. 37, for 100.0 feet; thence run South 87 degrees 53 minutes West for 200 feet; thence run North 00 degrees 19 minutes West for 100.0 feet; thence run North 87 degrees 53 minutes East for 200 feet to the said point of beginning; together with all improvements thereon and all appurtenances thereunto appertaining.

The above described property which is hereby conveyed is further described as the identical property conveyed by Erie M. Hall and wife, Virginia H. Hall, to Frank Reed by Deed dated July 26, 1958.

This Notice is ordered by Lee County Circuit Judge Jacob A. Walker, III on the 21st day of October, 2020.
