In accordance with Title 11-52-77 of the Alabama Code, as amended and the Zoning Ordinance of the City of Auburn, notice is hereby given that the City Council of the City of Auburn will

hold a public hearing on Tuesday, May 18, 2021 at 7:00 p.m., in the Council Chambers of the Auburn Public Safety Building, 141 North Ross Street, to consider the following:

AN ORDINANCE TO FURTHER AMEND ORDINANCE NO. 1883 OF THE CITY OF AUBURN, DATED DECEMBER 21, 1999, AS AMENDED, TO REZONE APPROXIMATELY 1.76 ACRES,

MORE OR LESS, LOCATED AT 2787 LEE ROAD 12 (COX ROAD) FROM RURAL (R) TO COMPREHENSIVE DEVELOPMENT DISTRICT (CDD)

BE IT ORDAINED by the City Council of the City of Auburn, Alabama, as follows:

Section 1. That Ordinance No. 1883 of the City of Auburn, Alabama dated December 21, 1999, as amended by subsequent amendments is further amended in the following respect:

The zoning map of the City of Auburn, Alabama, which is made an exhibit to and is a part of said Ordinance No. 1883, is amended to rezone approximately 1.76 acres, more or less, located

at 2787 Lee Road 12 (Cox Road) from Rural (R) to Comprehensive Development District (CDD). The following describes the real property:

The property in question is more specifically described as follows:

A parcel of land situated in the Northeast Quarter of the Northeast Quarter of Section 15, Township 18 North, Range 25 East, Lee County, Alabama, said parcel being more particularly

described as follows:

Commence at a found . inch open top pipe marking the Northeast corner of said Section 15, said point also marking a corner on the South line of Lot 2, Re-Subdivision of Lot 2 Auburn

Technology Park North, as recorded in Plat Book 28, Page 166, in the Probate Office of Lee County, Alabama; thence run South 88 degrees 56 minutes 15 seconds West along the South line

of said Lot 2 of Re-Subdivision of Lot 2 Auburn Technology Park North and along Lot 4A, 4B and Common Area of Resurvey of Lot 4 Auburn Technology Park North as recorded in Plat

Book 31, Page 16, in the Probate Office of Lee County, Alabama, and also along the North line of said Section 15 for a distance of 1,235.22 feet to a set 5/8 inch capped rebar stamped CA-

560LS, said point lying on the existing Cox Road Right of Way (R.O.W. Varies); thence run South 09 degrees 23 minutes 34 seconds West along said Cox Road Right of Way for a distance of

296.45 feet to a found concrete monument stamped 185+55.37 PLS27397; thence run South 01 degrees 02 minutes 24 seconds West along said Cox Road Right of Way for a distance of 145.79

feet to a found capped rebar stamped BASELINE CA-922, said point being the POINT OF BEGINNING of the parcel herein described; thence leaving said Right of Way run South 87 degrees

18 minutes 31 seconds East for a distance of 319.81 feet to a point; thence run South 00 degrees 22 minutes 11 seconds West for a distance of 239.33 feet to a point; thence run North 87 degrees

18 minutes 28 seconds West for a distance of 319.72 feet to a found capped rebar stamped BASELINE CA-922, said point lying on said Cox Road Right of Way; thence run North 00 degrees 20

minutes 59 seconds East along said Cox Road Right of Way for a distance of 239.33 feet to the POINT OF BEGINNNG. Said Parcel contains 76,465 Square Feet or 1.76 Acres more or less.

Section 2. If any section or provision of this ordinance be declared invalid or unconstitutional by judgment or decree of a court of competent jurisdiction, such judgment or decree shall

not affect any other section or provision of this ordinance.

Section 3. This ordinance shall take effect upon its approval by the City Council or upon its otherwise becoming law, but shall be published as required by law and codified as part of the

Code of Auburn, Alabama.
