NOTICE OF PUBLIC HEARING

In accordance with Title 11-52-77 of the Alabama Code, as amended and the Zoning Ordinance of the City of Auburn, notice is hereby given that the City Council of the City of Auburn will

hold a public hearing on Tuesday, May 4, 2021, at 7:00 p.m. in the Council Chambers of the Auburn Public Safety Department located at 141 North Ross Street. The purpose of the public

hearing is to consider the following:

AN ORDINANCE TO FURTHER AMEND ORDINANCE NO. 1883 OF THE CITY OF AUBURN, DATED DECEMBER 21, 1999, AS AMENDED, TO REZONE APPROXIMATELY 33.89 ACRES,

MORE OR LESS, AT THE WESTERN TERMINUS OF ACADEMY DRIVE FROM RURAL (R) (PENDING ANNEXATION PL-2021-00109) TO DEVELOPMENT DISTRICT HOUSING (DDH).

BE IT ORDAINED by the City Council of the City of Auburn, Alabama, as follows:

Section 1. That Ordinance No. 1883 of the City of Auburn, Alabama dated December 21, 1999, as amended by subsequent amendments is further amended in the following respect:

The zoning map of the City of Auburn, Alabama, which is made an exhibit to and is a part of said Ordinance No. 1883, is amended to rezone approximately 33.89 acres, more or less, at the

western terminus of Academy Drive from Rural (R) (pending annexation PL-2021-00109) to Development District Housing (DDH). The following describes the real property:

The property in question is more specifically described as follows:

Legal Description: ALL THAT TRACT OR PARCEL OF LAND lying and being in Section 16, Township 19 North, Range 26 East, City of Auburn, Lee County, Alabama and being more

particularly described as follows: Commencing from a point at the centerline intersection of Academy Drive and Gatewood Drive; Thence leaving said intersection, North 60 degrees 24

minutes 53 seconds West, a distance of 703.79 feet to an iron pin found (1/2” rebar), said pin being the POINT OF BEGINNING; Thence South 89 degrees 49 minutes 50 seconds West, a

distance of 1622.28 feet to an iron pin found (1” open top pipe); Thence North 00 degrees 59 minutes 45 seconds East, a distance of 743.73 feet to a 1/2" rebar and cap set; Thence North 75

degrees 55 minutes 39 seconds East, a distance of 210.02 feet to a 1/2" rebar and cap set ; Thence along an arc of a curve to the left, an arc length of 164.67 feet, having a radius of 840.00 feet,

and being subtended by a chord bearing of North 68 degrees 58 minutes 31 seconds East, a chord distance of 164.41 feet to a 1/2" rebar and cap set; Thence North 61 degrees 21 minutes 33

seconds East, a distance of 309.55 feet a 1/2" rebar and cap set ; Thence along an arc of a curve to the left, an arc length of 300.64 feet, having a radius of 740.00 feet, and being subtended by a

chord bearing of North 49 degrees 38 minutes 47 seconds East, a chord distance of 298.57 feet to a 1/2" rebar and cap set; Thence South 89 degrees 17 minutes 36 seconds East, a distance of

363.46 feet to a 1/2" rebar and cap set; Thence North 00 degrees 42 minutes 24 seconds East, a distance of 34.33 feet to a 1/2" rebar and cap set ; Thence South 89 degrees 47 minutes 21

seconds East, a distance of 198.57 feet to a 1/2" rebar and cap set ; Thence South 00 degrees 11 minutes 44 seconds East, a distance of 19.36 feet to a 1/2” open top pipe found; Thence South 00

degrees 10 minutes 07 seconds East, a distance of 1013.44 feet to a 1/2” open top pipe found; Thence South 00 degrees 39 minutes 26 seconds East, a distance of 70.62 feet to a 1/2" open top

pipe found;, Thence South 58 degrees 04 minutes 53 seconds East, a distance of 220.09 feet to an iron pin found (1/2” rebar), said pin being the POINT OF BEGINNING. Said tract containing

33.84 acres or 1,473,977.90 square feet.

Section 2. If any section or provision of this ordinance be declared invalid or unconstitutional by judgment or decree of a court of competent jurisdiction, such judgment or decree shall

not affect any other section or provision of this ordinance.

Section 3. This ordinance shall take effect upon its approval by the City Council or upon its otherwise becoming law, but shall be published as required by law and codified as part of the

Code of Auburn, Alabama.
